1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Afranic Travel & tours and you. By accessing and using our website, booking services, or engaging with our products and services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our Services.

2. Use License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for lawful purposes only. You agree not to use our Services in any manner that could damage, disable, overburden, or impair our systems or interfere with other users’ access to our Services. Prohibited behavior includes harassment, hate speech, threats, obscenity, or any unlawful conduct.

3. Booking and Reservation Policy

3.1 Booking Process

When you book a tour or travel service through Afrani Travel, you are entering into a binding contract with us. All bookings are subject to availability and confirmation by our team. A booking is only confirmed once you receive a confirmation email with your booking reference number and payment has been successfully processed.

3.2 Booking Requirements

To complete a booking, you must provide accurate and complete information including your full name, contact details, passport information (for international travel), and any special requirements or preferences. You are responsible for ensuring all information is correct. Any errors or omissions in your booking details are your responsibility.

3.3 Minimum Age Requirements

Travelers must be at least 18 years old to book independently. Minors (under 18) must be accompanied by an adult guardian. We reserve the right to request proof of age and guardianship documentation.

4. Payment Terms

4.1 Payment Methods

We accept various payment methods including credit cards, debit cards, bank transfers, and other electronic payment systems. Payment must be made in full or according to the payment plan specified at the time of booking.

4.2 Currency and Pricing

All prices are quoted in USD unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors. Exchange rates for currency conversions are calculated at the time of payment.

4.3 Deposits and Final Payment

A non-refundable deposit of 30% is required to secure your booking. The remaining balance must be paid in full no later than 30 days before your tour departure date. Failure to pay the final balance by the due date may result in automatic cancellation of your booking.

4.4 Payment Security

All payment information is processed through secure, encrypted payment gateways. We do not store your full credit card details on our servers. You are responsible for maintaining the confidentiality of your payment information and account credentials.

5. Cancellation and Refund Policy

5.1 Cancellation by Customer

You can cancel the safari up to 1 week before starting. After that period, we have to pay the Parc fees and reserve the tents already and also order your food, so later its not possible to get a refund anymore.

If you book long time before coming, you can pay a deposit of 100 US-Dollar to our Dollar-Account to reserve the dates for safari. Because of the planing and writing the itinerary, this deposit won’t be refunded if you cancel.

5.2 Cancellation by Company

We reserve the right to cancel or modify tours due to circumstances beyond our control, including but not limited to natural disasters, political unrest, pandemics, extreme weather, or insufficient bookings. In such cases, we will offer a full refund or the option to reschedule to an alternative date.

5.3 No-Show Policy

If you fail to appear for your booked tour without prior notice, your booking will be considered a no-show. No refund will be issued, and you will forfeit all payments made.

6. Tour Modifications and Changes

6.1 Company Right to Modify

Afrani Travel reserves the right to modify tour itineraries, accommodations, or activities due to unforeseen circumstances, local conditions, or operational requirements. We will make reasonable efforts to provide equivalent alternatives. Minor changes do not entitle you to a refund.

6.2 Customer-Initiated Changes

If you wish to modify your booking after confirmation, changes are subject to availability and may incur additional fees. Modification requests must be submitted at least 14 days before your tour departure date.

7. Traveler Responsibilities and Conduct

7.1 Travel Documents

You are responsible for obtaining all necessary travel documents, including valid passports, visas, vaccinations, and travel insurance. Your passport must be valid for at least six months beyond your travel dates. We are not responsible for denied entry due to missing or invalid documentation.

7.2 Health and Fitness

You confirm that you are in good physical and mental health and are capable of participating in the tour activities. You are responsible for disclosing any medical conditions, allergies, or mobility restrictions that may affect your participation. We reserve the right to refuse participation if we believe you pose a health or safety risk.

7.3 Conduct and Behavior

You agree to conduct yourself respectfully and lawfully during all tour activities. Behavior that is disruptive, offensive, illegal, or endangers others may result in immediate removal from the tour without refund. You will be responsible for any damages caused by your misconduct.

7.4 Compliance with Local Laws

You agree to comply with all local laws, customs, and regulations of the countries and regions you visit. Afrani Travel is not responsible for any legal consequences resulting from your violation of local laws.

8. Liability and Disclaimers

8.1 Assumption of Risk

By participating in our tours, you acknowledge that travel involves inherent risks, including but not limited to accidents, illness, injury, or death. You assume all risks associated with travel and tour participation.

8.2 Limitation of Liability

Afrani Travel’s total liability for any claim arising from our Services shall not exceed the amount you paid for the tour. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or enjoyment.

8.3 Third-Party Services

Our tours may include services provided by third parties, including airlines, hotels, restaurants, and activity operators. Afrani Travel acts only as an intermediary and is not responsible for the quality, safety, or performance of these third-party services. Third parties are responsible for their own liability.

8.4 Travel Insurance

We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and lost baggage. Travel insurance is not included in our tour packages.

8.5 Force Majeure

Afranic Travel is not liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or strikes.

9. Intellectual Property Rights

All content on our website, including text, images, videos, logos, and designs, is the intellectual property of Afrani Travel or our licensors. You may not reproduce, distribute, modify, or transmit any content without our prior written permission. Unauthorized use may violate copyright, trademark, and other intellectual property laws.

10. User-Generated Content

If you submit reviews, photos, testimonials, or other content to our platform, you grant Afrani Travel a non-exclusive, royalty-free license to use, reproduce, and display this content for marketing and promotional purposes. You represent that you own or have permission to use all submitted content.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Afrani Travel is registered, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall first be subject to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce.

12.3 Limitation Period

Any legal action or proceeding arising from these Terms must be commenced within one year of the date the cause of action arises. After one year, the right to bring an action is barred.

13. Indemnification

You agree to indemnify, defend, and hold harmless Afrani Travel, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising from your use of our Services, violation of these Terms, or violation of any third-party rights.

14. Accessibility and Accommodations

Afrani Travel is committed to providing accessible services to all travelers. If you require accessibility accommodations or have specific mobility needs, please notify us at least 30 days before your tour departure date. We will make reasonable efforts to accommodate your needs, subject to availability and feasibility.

15. Communication and Notices

All communications regarding your booking, including confirmations, updates, and important notices, will be sent to the email address you provided during registration. You are responsible for checking your email regularly. We are not responsible for missed communications due to incorrect email addresses or spam filters.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically for any changes.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Afrani Travel regarding your use of our Services and supersede all prior agreements and understandings.
